The effects of the injunctions of payment extended to the partners of a general partnership

Pursuant to a recently issued judgement of the Italian Supreme Court (6734/2011), which stated this way a general principle already contained in the positive law, the injunction of payment issued towards a general partnership extends its legal effects also towards the single partners.

So that, each of them must file up the opposition against the injuction, and, failing that, the injunction itself can be enforced against the non opponent partners.
