Pursuant to the Human Rights Court, the right of the parents to live their relation with the sons is an inviolable human right.


After the divorce, the plaintiff’s son was entrusted to his mother and the Courth House stated that the father could visit the kid each 15 days.
Nevertheless, after a first period of armony, afterwards the mother, to revenge against the father, started denying him to see the son and to put him against the father.
The father lodged sue before the Court House first and then before the European Human Rights Court.
The kid in fact started to hate his father, soaking up from his mother the same hate she had toward his dad.
Both Italian and European Courts recognized that the mother had given him subliminal messages telling him things as such as “today you must see your dad”. The Human Right Court recognized it was a strategy, unconscious maybe, but getting straight away into the kid’s mind.
Although the decision of the Court House, the father couldn’t see his own son and his life was ruined.
The Court House, lodged again by the father shortly afterward, considered the mother responsible for interrupting the relation between the kid and his dad, and ordered to social services to assure the father to see the kid, but at that point the kid himself didn’t want to spend time anymore with his dad.
Pursuant to the Human Rights Court, in light of events, the Italian Court House and the social services in this case took their decisions with a big delay and adopted measures uneffective which didn’t protect the father’s rights and didn’t guarantee the plaintiff to exercise his right to see his own kid.
For this reason the European Human Rights Court charged Italy to indemnify the plaintiff with 15.000,00 of moral damages.
