Pursuant to the European Justice Court it's illegal to convict the illegal imigrants

Pursuant to the Supreme European Justice Court (Decision n. 61/2011) there's a conflict, therefore solved with the supremacy of comunitarian law, between the Directive n. 2008/115/CE, which regulates the rempatriation of the illegal citizens coming from extraUE countries, with the internal regulation of the States whose rules provide the imprisonement of the illegal imigrant for the only reason that this one violated the order to leave the territory of the State by the legal term provided without a valid reason.
