If the contractor admits the existence of defects, a new novative obligation rises up subdued to a 10 year period of termination

Pursuant to the Italian Supreme Court (5388/2011), the contractor who admits the existence of defects and of his liability, binds himself to delete the defects and propose the solutions for their elimination.

In such cases, a new obligation binding the contractor rises up, implying a novation in substitution of the originary one, and subdued to a 10 year period of termination.
